Terms of Use

These are the terms between you and [REPLACE: Legal entity name] for the 5erday app. Using the app means agreeing to them.
What 5erday is
A diary for counting fruit and vegetable portions against the UK's public 5 A DAY guidance, with an optional camera feature that estimates portions from a photograph.
What it is not
5erday is not medical advice and not a medical device. It does not diagnose, treat or prevent anything, and it is not a substitute for advice from a doctor or a registered dietitian. Portion figures follow published public guidance and are rounded, approximate and general. If you have a medical condition, are pregnant, or are managing a specific diet, take advice from a professional rather than from an app.
The camera estimate is an estimate
The photo analysis uses a machine-learning model. It will sometimes identify the wrong food, miss something, or misjudge a quantity. That is why nothing is added to your diary until you have looked at it and confirmed it. Treat every estimate as a suggestion to correct, not a measurement. Do not rely on it where being wrong would matter, such as managing an allergy or a clinical diet.
Your account
- An account is optional. Most of the app works without one.
- You are responsible for keeping your sign-in details to yourself.
- One account per person. Please do not create accounts to get around the free scan allowance.
- We may suspend an account being used to abuse the service, for example automated scanning, or attempts to get at other people's data.

An unused allowance does not roll over. The month's count resets at the start of each UTC calendar month.
The allowance is a number, not an absence of one. We describe 5erday+ as up to 200 analyses a month because that is what it is. We do not call it unlimited.
Deleting your account does not cancel your subscription. Only your app store can do that. Cancel there first: see Delete your account.
The free allowance
Everyone gets 20 successful AI analyses. They are a lifetime allowance rather than a monthly one, and they are counted per account. Only a successful analysis counts: opening the camera, retaking a photo, a failed analysis, a timeout and an outage all cost nothing.
Your data
What you log belongs to you. We do not claim any rights over it, and we do not use your photographs or your diary to train anything. How it is handled is set out in the Privacy Policy, which forms part of these terms.
Availability
We try to keep 5erday working, but we do not promise it will always be available. In particular, the camera feature depends on a third-party model that can be slow, unavailable or wrong, and we may pause it temporarily if it is broken or is costing more than the service can bear. Logging by hand keeps working when it is paused.
We may change or discontinue features. If we remove something you are paying for, you can cancel and, where the law requires it, get a refund for what you have not used.
Liability
Nothing here limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
Otherwise, and to the extent the law allows: the app is provided as it is; we are not liable for indirect or consequential loss; and our total liability for any claim is limited to what you have paid us in the twelve months before it arose.
You use the portion estimates at your own judgement. We are not liable for dietary decisions made on the strength of an estimate the app asked you to check.
Ending things
You can stop using 5erday whenever you like, and delete your account and all of its data from inside the app: see Delete your account. We may end your access if you break these terms in a way that matters.
Changes to these terms
We will tell you in the app before a material change takes effect. Continuing to use 5erday after that means accepting the new version.
Law
These terms are governed by the law of England and Wales, and its courts have jurisdiction. If you are a consumer, this does not take away rights you have under the law of the country you live in.
